पुनरीक्षण धारा 115 CPC

(1) उच्च न्यायालय किसी भी ऐसे मामले के अभिलेखो को मंगवा सकेगा जिसका ऐसे उच्च न्यायालय के अधीनस्थ किसी न्यायालय ने विनिश्चय किया है और जिसकी कोई अपील भी नहीं होती है और यदि यह प्रतीत होता है कि -


(क) ऐसे अधीनस्थ  न्यायालय ने ऐसी अधिकारिता का प्रयोग किया है जो उस में विधि द्वारा निहित नहीं है, अथवा

( ख) ऐसा अधीनस्थ न्यायालय ऐसी अधिकारिता का प्रयोग करने में असफल रहा है जो इस प्रकार निहित है, अथवा


( ग) ऐसे ऐसे अधीनस्थ  न्यायालय ने अपनी अधिकारिता का प्रयोग करने में अवैध रूप से या तात्विक अनियमितता से कार्य किया है,


तो उच्च न्यायालय उस मामले में ऐसा आदेश कर सकेगा जो वह ठीक समझे: 


परंतु उच्च न्यायालय, किसी वाद या अन्य कार्रवाई के अनुक्रम में इस धारा के अधीन किए गए किसी आदेश में या कोई विवाद्यक विनिश्चित करने वाले किसी आदेश में तभी फेरफार करेगा या उसे उल्टेगा जब ऐसा आदेश यदि वह  पुनरीक्षण के लिए आवेदन करने वाले पक्षकार के पक्ष में किया गया होता तो वाद या अन्य कार्यवाही का अंतिम रूप से निपटारा कर देता। 

( 2) उच्च न्यायालय इस धारा के अधीन किसी ऐसे डिक्री या आदेश, जिसके विरुद्ध या तो उच्च न्यायालय में या उसके अधीनस्थ किसी न्यायालय में अपील होती है, में फेरफार नहीं करेगा अथवा उसे नहीं उलटेगा।


(3) पुनरीक्षण न्यायालय के समक्ष वाद या अन्य कार्यवाही के स्थगन स्थगन के रूप में प्रवर्त होगा, जब ऐसे वाद या अन्य कार्यवाही को उच्च न्यायालय द्वारा स्थगित कर दिया जाता है।


स्पष्टीकरण- इस धारा में " ऐसे मामले के अभिलेखों मंगवा सकेगा जिसका ऐसे उच्च न्यायालय के अधीनस्थ किसी न्यायालय ने विनिश्चय किया है" अभिव्यक्ति के अंतर्गत किसी वाद या अन्य कार्यवाही के अनुक्रम में किया गया कोई आदेश या कोई विवाद्यक विनिश्चित करने वाला कोई आदेश भी है।


सिविल प्रक्रिया संहिता में यह एक महत्वपूर्ण उपबंध है। स्वच्छ न्याय प्रशासन की अवधारणा न्याय के उद्देश्यों की प्राप्ति में निहित है, चाहे ऐसा न्याय किसी भी न्यायालय द्वारा क्यों ना प्रदान किया गया हो। यह बात महत्वपूर्ण नहीं है कि निर्णय निम्न न्यायालय द्वारा प्रदान किया गया है अथवा अपर न्यायालय द्वारा। निम्न न्यायालय द्वारा प्रदत निर्णय यदि न्याय के उद्देश्यों को प्राप्त कर लेता है तो उसका उतना ही महत्व होगा जितना की अपर न्यायालय के निर्णय का होता, और ऐसी अवस्था में निम्न न्यायालय के निर्णय मैं अपर न्यायालय कभी भी हस्तक्षेप नहीं करेगा। लेकिन जहां निम्न न्यायालय का निर्णय न्याय के सारभूत उद्देश्यों को प्राप्त करने में असफल रहता है, वहां पर अप्पर न्यायालय का हस्तक्षेप आवश्यक हो जाता है।


इस प्रकार पुनरीक्षण का मुख्य उद्देश्य अधीनस्थ न्यायालय के क्षेत्राधिकार संबंधी त्रुटियां, अनियमिताएं एवं और अवैधानिकता को दूर कर न्याय के उद्देश्यों को प्राप्त करना है।


सिविल प्रक्रिया संहिता की धारा 115 के अनुसार पुनरीक्षण निम्न अवस्था में किया जा सकेगा -


( 1) जहां कोई मामला उच्च न्यायालय के अधीनस्थ किसी न्यायालय द्वारा विनिश्चित किया जाता है और जिसकी अपीलीय न्यायालय में अपील नहीं होती है और यदि यह प्रतीत होता है कि-


( क) ऐसे अधीनस्थ न्यायालय ने ऐसे क्षेत्राधिकार का प्रयोग किया है जो उसमें विधि द्वारा निहित नहीं है, या


( ख) ऐसे अधीनस्थ न्यायालय ने ऐसे क्षेत्राधिकार का प्रयोग करने में असफल रहा है जो उसने विधि द्वारा निहित है, या


( ग) ऐसे अधीनस्थ न्यायालय ने अपने क्षेत्र अधिकार का प्रयोग करने में अवैध रूप से सारवान अनियमितता से कार्य किया है,


तो ऐसा उच्च न्यायालय ऐसे किसी मामले के अभिलेखों मंगवा सकेगा और उच्च न्यायालय उस मामले में ऐसा आदेश दे सकेगा जैसा कि वह ठीक समझता है।


लेकिन उच्च न्यायालय किसी मामले में विनिश्चित किसी वाद पद अथवा आदेश को तब तक ना तो उल्टेगा ना उसमें परिवर्तन करेगा जब तक उसका यह समाधान नहीं हो जाता है कि यदि ऐसा बाद पद या आदेश पुनरीक्षण करने वाले पक्षकार के पक्ष में पारित किया गया होता तो मामले का अंतिम रूप से निपटारा हो जाता।

Obiter Dicta - Meaning

The literal meaning of this Latin expression is ―said by the way‖. The expression is used especially to denote those judicial utterances in the course of delivering a judgement which taken by themselves, were not strictly necessary for the decision of the particular issue raised. These statements thus go beyond the requirement of a particular case and have the force of persuasive precedents only. The judges are not bound to follow them although they can take advantage of them. They some times help the cause of the reform of law. Obiter Dicta are of different kinds and of varying degree of weight. Some obiter dicta are deliberate expressions of opinion given after consideration on a point clearly brought and argued before the court. It is quite often too difficult for lawyers and courts to see whether an expression is the ratio of judgement or just a causal opinion by the judge. It is open, no doubt, to other judges to give a decision contrary to such obiter dicta.
